Welcome to Mooleren. These Terms of Service (“Terms”) govern your access to and use of the Mooleren website, online store, products, content, features, tools, and related services (collectively, the “Services”).

The terms “Mooleren,” “we,” “us,” and “our” refer to Mooleren, owned and operated by Craft Sale Marketing LLC. Mooleren is powered by Shopify, which enables us to provide the Services to you.

Please read these Terms carefully. By visiting, accessing, using, or purchasing from the Services, you agree to be bound by these Terms, together with any policies referenced in these Terms, including our Privacy Policy, Refund Policy, and Shipping Policy. If you do not agree to these Terms, you should not access or use the Services.

Section 1 - Access and Account

By using the Services, you represent that you are at least the age of majority in your state, province, or country of residence, or that you have given us your consent to allow any minor dependents to use the Services on devices you own or manage.

To use certain parts of the Services, including placing an order, you may be asked to provide information such as your name, email address, billing information, payment information, shipping address, and other order-related details. You represent and warrant that all information you provide is accurate, current, and complete, and that you have the necessary rights to provide such information.

You are responsible for maintaining the confidentiality of any account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.

Section 2 - Our Products

Mooleren offers handcrafted decorative wood products, including custom vent covers and related home decor items.

We make every effort to display our products as accurately as possible. However, colors, wood tones, grain patterns, textures, dimensions, finish, and overall appearance may vary depending on your screen, device settings, production process, and the natural character of the materials used.

Because many of our products are handcrafted and made from wood or plywood, slight variations in finish, shade, texture, pattern, grain, and appearance are normal and do not constitute defects.

Some products may be custom, personalized, made-to-order, or produced according to the size, style, or specifications selected by the customer. Please review all product details carefully before placing your order.

We do not guarantee that the appearance of any product will exactly match how it appears on your screen. All product descriptions, prices, availability, and specifications are subject to change at any time without notice. We reserve the right to discontinue any product at any time and to limit quantities offered to any person, region, or jurisdiction.

Section 3 - Orders

When you place an order, you are making an offer to purchase the selected products. Mooleren reserves the right to accept, decline, cancel, or limit any order at its discretion.

Your order is not accepted until payment has been received and processed and we confirm the order. Please review your order carefully before submitting it. Once an order has been accepted or production has started, cancellation or modification may not be possible.

If we do not accept, modify, or cancel an order, we will attempt to notify you using the email address, billing address, shipping address, or phone number provided at checkout.

Your purchases are subject to our Refund Policy.

You represent and warrant that your purchases are for personal or household use only and not for resale, unauthorized commercial use, or unlawful export.

Section 4 - Prices and Billing

Prices, discounts, promotions, and availability are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and will be stated in your order confirmation email.

Unless otherwise expressly stated, posted prices do not include taxes, customs duties, import charges, or similar fees. Shipping terms, customs duties, taxes, and import fees are addressed in our Shipping Policy and on applicable product or checkout pages.

You agree to provide current, complete, and accurate purchase and account information for all transactions. You agree to promptly update your information so we can complete your order and contact you if necessary.

You represent and warrant that: (i) the payment information you provide is accurate and complete; (ii) you are authorized to use the payment method provided; and (iii) you will pay all charges incurred, including shipping charges, taxes, customs duties, and other applicable fees where required.

Section 5 - Shipping and Delivery

Orders are processed and shipped according to our Shipping Policy. Delivery times are estimates only and are not guaranteed.

We are not liable for shipping delays caused by carriers, customs clearance, local postal services, weather, seasonal demand, force majeure events, incorrect delivery information, or other circumstances outside our reasonable control.

Once an order has been shipped, you will receive tracking information where available. You can find more information on our Track Your Order page.

Risk of loss passes to you when the products are transferred to the carrier, to the extent permitted by applicable law. If your order is marked as delivered but you have not received it, please contact the carrier first and then contact us at sales@mooleren.com so we can help review the issue.

Section 6 - Returns, Refunds, and Warranty

Returns, refunds, exchanges, damaged items, incorrect items, and non-returnable items are governed by our Refund Policy.

If your item arrives damaged, defective, or incorrect, please contact us promptly at sales@mooleren.com with your order number and clear photos of the issue.

Mooleren products may be covered by a limited warranty as described on our website, product pages, FAQs, or other applicable policy pages. Warranty coverage does not apply to damage caused by misuse, improper installation, modification, normal wear and tear, accidents, or failure to follow product instructions.

Section 7 - Intellectual Property

All content available through the Services, including but not limited to trademarks, brand elements, text, graphics, images, product photos, videos, reviews, designs, layouts, product names, and overall presentation, is owned by Mooleren, its affiliates, licensors, or content suppliers and is protected by applicable intellectual property laws.

You may use the Services only for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, scrape, copy, or transmit any part of the Services without our prior written consent.

Mooleren’s name, logo, product names, and related branding are trademarks or brand assets of Mooleren or its licensors. Shopify’s trademarks remain the property of Shopify. All other trademarks belong to their respective owners.

Section 8 - Optional Tools and Third-Party Services

We may provide access to third-party tools, apps, integrations, payment processors, shipping providers, review tools, analytics tools, marketing tools, or other services that we do not own or control.

These third-party tools and services are provided “as is” and “as available” without warranties, representations, or conditions of any kind from us. Your use of optional third-party tools is entirely at your own risk and discretion and may be subject to the third party’s own terms and policies.

Any future features, services, or tools added to the Services shall also be subject to these Terms.

Section 9 - Third-Party Links

The Services may include links to third-party websites, content, platforms, or services. We are not responsible for examining or evaluating the content, accuracy, availability, security, or policies of any third-party websites.

If you choose to access third-party websites, you do so at your own risk. We are not liable for any harm, loss, or damages related to your access to or use of any third-party materials, websites, products, or services.

Section 10 - Relationship with Shopify

Mooleren is powered by Shopify, which enables us to provide the Services to you. However, all sales and purchases made through this store are transactions directly between you and Mooleren.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and Mooleren, including any injury, damage, loss, delivery issue, refund issue, product issue, or dispute arising from products purchased through the store. You expressly release Shopify and its affiliates from claims arising out of or related to your transactions with Mooleren.

Section 11 - Privacy

All personal information collected through the Services is subject to our Privacy Policy. Certain personal information may also be collected and processed by Shopify in accordance with Shopify’s own privacy policies.

Because the Services are hosted by Shopify, Shopify may collect and process personal information to provide, secure, and improve the Services. Information you submit may be transferred to or processed by Shopify and third-party service providers in countries other than your own.

By using the Services, you acknowledge that you have read our Privacy Policy.

Section 12 - Feedback, Reviews, and Submissions

If you submit ideas, suggestions, reviews, photos, videos, feedback, proposals, comments, or other materials (“Feedback”), you grant us a perpetual, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, publish, distribute, display, and create derivative works from such Feedback for any purpose, including commercial, marketing, advertising, and promotional purposes.

You represent and warrant that: (i) you own or control all rights in the Feedback; (ii) your Feedback does not violate any law or third-party right; and (iii) your Feedback is accurate and not misleading.

We are under no obligation to keep Feedback confidential, to pay compensation for it, or to respond to it. We may remove, edit, or refuse any Feedback at our sole discretion.

Section 13 - Errors, Inaccuracies, and Omissions

Occasionally there may be information on the Services that contains typographical errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, offers, shipping charges, transit times, product availability, images, or specifications.

We reserve the right to correct such errors, update information, change or cancel orders, or refuse service at any time without prior notice, including after an order has been submitted, to the extent permitted by applicable law.

You may use the Services only for lawful purposes. You may not use the Services:

Any such technology must accurately identify itself and must not disguise automated access as human behavior, bypass security features, circumvent CAPTCHAs, overload infrastructure, scrape protected content, or evade restrictions that control access to the Services.

We may restrict, block, throttle, or prohibit automated access at any time by technical or legal means.

We may terminate or suspend your access to the Services at any time, without notice, in our sole discretion, if we believe you have violated these Terms or used the Services in a harmful, fraudulent, unlawful, or abusive manner.

You remain liable for all obligations incurred up to the date of termination.

Any provisions that by their nature should survive termination shall survive, including but not limited to provisions relating to intellectual property, disclaimers, limitation of liability, indemnification, payment obligations, governing law, and dispute resolution.

The Services and all products offered through them are provided on an “as is” and “as available” basis, except as expressly stated otherwise by Mooleren or required by applicable law.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.

We do not guarantee that your use of the Services will be uninterrupted, timely, secure, error-free, accurate, or reliable.

Nothing in these Terms excludes, limits, or modifies any rights you may have under applicable consumer protection laws that cannot lawfully be excluded, limited, or modified.

Section 18 - Limitation of Liability

To the fullest extent permitted by law, Mooleren, Craft Sale Marketing LLC, Shopify, and our respective affiliates, officers, directors, employees, contractors, service providers, licensors, partners, and agents shall not be liable for any direct, indirect, incidental, special, punitive, exemplary, or consequential damages arising from your use of the Services or any products purchased through the Services, including but not limited to loss of profits, loss of revenue, loss of savings, loss of data, replacement costs, business interruption, or similar damages, whether based in contract, tort, negligence, strict liability, or otherwise.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Services or products shall not exceed the amount you paid for the product giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

Section 19 - Indemnification

You agree to indemnify, defend, and hold harmless Mooleren, Craft Sale Marketing LLC, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, licensors, contractors, and service providers from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to: (i) your breach of these Terms; (ii) your violation of any law or third-party rights; (iii) your misuse of the Services; or (iv) any Feedback or content you submit.

Section 20 - Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by law, or severed if necessary, and the remainder of the Terms shall remain in full force and effect.

Section 21 - Waiver; Entire Agreement

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

These Terms, together with any policies posted on this site, including our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and us regarding your use of the Services and supersede all prior agreements, communications, and proposals.

Section 22 - Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law.

Section 23 - Governing Law

These Terms of Service and any separate agreements through which we provide the Services shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

You consent to the exclusive jurisdiction and venue of the state and federal courts located in Delaware, United States, to the extent permitted by applicable law.

The headings used in these Terms are included for convenience only and do not limit or otherwise affect the interpretation of these Terms.

Section 25 - Changes to These Terms

We reserve the right to update, change, or replace any part of these Terms by posting updates on our website.

It is your responsibility to check this page periodically for changes. Your continued use of the Services following the posting of changes constitutes acceptance of those changes.
